[2002] EWHC 490. While in the defendant's restaurant, the claimant sustained skin burns while handling a plastic cup of coffee. She claimed under the Consumer protection act (1987), alleging that the coffee cup was defective, and that this defect had caused her injury. Her claim failed, because the mere fact that a product is capable of causing injury does not, in itself, make it defective. It would be reasonable to expect a person to take more care when handling what was clearly a very hot liquid in a not-particularly-substantial container.
