From Law wiki, the wiki for law research[1953] AC 643 (HL). The claimant sued the defendant, his employer, in Negligence and forbreach of statutory duty. The claimant had suffered injury when he slipped on a floor that had become contaminated with oil during a recent flood. The House of lords held that the duty imposed at common law and under statute was not an absolute one -- the claimant had to show that a reasonable employer would be likely to have acted differently from the defendant.
