C-66/85. The claimant, who was not a German national, was refused entry to Germany to take up a post as a trainee teacher. The German authorities argued that this post did not constitute 'work' for the purposes of Art. 39 of the ECTreaty, being paid only a notional amount, and thus the rights ofFree Movement Of Workers did not apply. However, the European Court of Justice held that the amount of renumeration was irrelevant, provided that the 'worker' was engaged in genuine economic activity. The ECJ gave an expansive definition to the term 'worker': a person who
...performs services for and under the direction of another person in return for which he receives renumeration.
