A right to enter or occupy property which takes efffect of a Personal right, rather than a Property right. That is, a licence is granted by one individual or group to another individual or group; it is not binding on anyone else. In particular, a licence is not an Estate in land and cannot be sold or transferred in its own right.

The difference between a Lease (which is an estate in land) and a licence (which is not) is not always clear, either in theory or in practice. A lease is an estate in land, and carries its own Title. In general a lease can be bought and sold like other property. The tenant of a leasehold property has certain well-defined rights which may be enforceable without the agreement of the Landlord. A licencee has none of these things, and is protected by fewer legal rightso (see Lease or licence).
