Sets out the maximum times which for which a claim for damages will be heard. The main provisions are:

  • for a simple contract (see: Simple contract), or a claim concerning Personal property, no more than 6 years may elapse from the time at which action could first have be taken;
  • for a contract by deed (see: Contract by deed), or a claim concerning Real property no more than 12 years may elapse from the time at which action could first have be taken;
  • if the claimant is unable to take action at the time at which it became possible, perhaps as a result of disability, then these time periods are to run from the point at which the claimant became capable.
  • such disability is only relevant if it is coincident with the point at which action could first be taken; disability during the 6-year or 12-year term does not extend the limitation.
