The defendant in this case, a local authority, failed to inspect the foundations of a building adequately, with the result that building became dangerously unstable. The claimant, unable to raise money for the repairs, was consequently forced to sell that house at a considerable loss, which he then sought to recover from the local authority. His action failed, thus bringing to an end the expansion in liability for pure economic loss experienced over the preceding twenty years.
