C-2/90. The Commission of the Eu challenged a measure in Belgian law prohibiting the importation of waste into a particular region of Belgium for disposal as being contrary to Art. 28 of the ECTreaty (see abolition of quantitative restrictions). The state argued that the measure pursued the legitimate aim of environmental protection, and should therefore be allowed. The question raised, therefore, was whether the list of exceptions to Art. 28 found in Art. 30 was exhaustive.

The ECJ did allow the measure to stand, but on the basis that waste had a particular status, and the measure did not therefore disciminate against imports, despite being worded to that effect. The question whether Art. 30 was exhaustive was thus not resolved one way or the other.
