The document that confirms the creation of a Trust (usually an Express trust) and sets out the terms by which it is to operate. A trust instrument may indicate that legal title to the trust property be transferred to the Trustee. Generally speaking, though, it will be necessary to follow the appropriate procedure in order to effect any such transfer (e.g. through creation of a deed of Conveyance in the case of land).
